These Terms of Use (“Terms”) are a binding agreement between you and Bovel governing your access to and use of the Bovel application, related websites, community features, content, and services (collectively, the “Services”). By using the Services, you agree to these Terms and the Privacy Policy.
1. Eligibility and accounts
You must be at least 13 years old, or the higher minimum age required in your country, to use the Services. If you are below the age of legal majority, a parent or legal guardian must review and agree to these Terms where required.
You must provide accurate information, keep your credentials secure, and promptly notify us of unauthorized access. You are responsible for activity under your account unless prohibited by law. You may not sell, transfer, impersonate, or create accounts through unauthorized automated means.
2. The Services
Bovel helps users plan sunset viewing, discover and share observation places and times, capture photos and ambient audio, create cinematic scene records, organize a film archive, interact with community content, and obtain eligible digital downloads. Features may vary by device, region, account status, permissions, and service availability.
We may improve, add, remove, suspend, or discontinue features. We will provide notice where required by law. You are responsible for compatible equipment, connectivity, device permissions, and any carrier charges.
3. Your content
“User Content” includes photos, audio, titles, captions, profile information, observations, places, dates, viewing times, comments, reports, and other material you submit. You retain ownership of your User Content.
You grant Bovel a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for technical presentation, distribute, display, and otherwise process User Content solely to operate, improve, secure, promote, and provide the Services. This license continues only as long as reasonably necessary for those purposes, subject to retention required for safety, legal compliance, disputes, and backup integrity.
You represent that you own or have all rights and permissions needed for your User Content; it is accurate where presented as factual; and our permitted use will not violate privacy, publicity, copyright, trademark, contractual, or other rights.
4. Acceptable use
You may not use the Services to:
Post unlawful, fraudulent, deceptive, defamatory, threatening, hateful, harassing, sexually exploitative, graphically violent, or otherwise objectionable material.
Exploit or endanger minors; disclose another person’s private information; stalk users; or encourage self-harm, violence, discrimination, or illegal conduct.
Upload content you do not have the right to use, including copyrighted media or another person’s image or voice without required permission.
Spam, manipulate likes or reports, impersonate others, coordinate abuse, evade restrictions, or submit knowingly false place, time, safety, or observation information.
Probe, interfere with, reverse engineer, overload, scrape, or access the Services through unauthorized automation, except where applicable law expressly permits.
Introduce malware, bypass security, misuse purchases or entitlements, or use the Services for commercial resale without written authorization.
5. Community safety and moderation
You can report content and block creators through available controls. We may investigate reports, use automated and human review, reduce distribution, remove content, preserve evidence, restrict features, suspend or terminate accounts, and contact authorities when appropriate. We may act without prior notice in urgent or serious cases.
Moderation systems cannot identify every violation, and a decision not to remove content does not endorse it. Repeated, malicious, or false reporting may itself violate these Terms. For urgent danger, contact emergency services rather than relying on in-app reporting.
6. Places, routes, times, and outdoor safety
Sunset times, viewing windows, scores, directions, weather-related notes, crowd descriptions, place details, routes, and community observations are informational estimates and may be incomplete, delayed, inaccurate, or affected by weather, terrain, closures, daylight rules, and changing conditions.
You are responsible for checking official sources, access rules, weather, transit, tides, daylight, and personal safety. Do not trespass, enter restricted areas, drive while using the Services, approach dangerous edges, or take risks to capture content. Bovel does not guarantee visibility, access, safety, or a particular photographic result.
7. Glow, digital content, and purchases
Glow is a digital entitlement used only for eligible features or content within the Services. Glow has no cash value, cannot be redeemed for money or property, does not represent a deposit or financial account, and may not be transferred or resold except where Bovel expressly permits.
Purchases made through the App Store are processed by Apple and are subject to Apple’s payment terms. Prices, taxes, product availability, and included Glow are shown before confirmation. Except where law or Apple policy requires otherwise, completed digital-content transactions are final. Refund requests for App Store transactions must be submitted through Apple’s authorized refund process.
We may correct balances affected by fraud, technical error, chargeback, or unauthorized activity. If a paid feature is discontinued, we will handle remaining entitlements as required by law and applicable platform rules.
8. Downloads and media use
Downloaded media is licensed for personal, non-commercial use unless a different license is clearly stated. A download does not transfer copyright, publicity rights, trademarks, or rights in depicted people, artwork, buildings, or locations. You may not resell, redistribute, remove rights notices, or use media in an unlawful or misleading manner.
9. Bovel intellectual property
The Services, including software, design, branding, interfaces, text, graphics, selection and arrangement of content, and Bovel-created media, are owned by Bovel or its licensors and protected by intellectual-property laws. Subject to these Terms, Bovel grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.
“Bovel,” its logo, and related marks are Bovel trademarks. No right to use them is granted except as necessary to use the Services. Feedback may be used without restriction or compensation, but we are not required to use it.
10. Third-party services
The Services may interact with Apple services, sign-in providers, maps, media libraries, device features, or external destinations. Third parties control their own services and terms. Bovel is not responsible for third-party availability, content, privacy, security, or practices. You must comply with applicable third-party agreements.
11. Suspension, termination, and account deletion
You may stop using the Services at any time and may request account deletion through available account controls. Deletion is subject to reasonable processing time and retention permitted or required for purchases, fraud prevention, safety, legal compliance, disputes, and enforcement.
We may suspend or terminate access when you materially or repeatedly violate these Terms, create risk or legal exposure, misuse purchases, or when necessary to protect the Services or community. Where appropriate and legally required, we will provide notice and an opportunity to appeal.
12. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Bovel disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Bovel does not warrant uninterrupted operation, error-free information, permanent availability of content, or any particular sunset, weather, route, safety, or creative outcome.
To the fullest extent permitted by law, Bovel and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunities, arising from the Services. Bovel’s aggregate liability for claims relating to the Services will not exceed the greater of US $100 or the amount you paid to Bovel through the Services during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.
13. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Bovel and its affiliates from claims, losses, and reasonable expenses arising from your User Content, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from Bovel’s own unlawful conduct.
14. Apple-specific terms
If you obtained the application through Apple’s App Store, you acknowledge and agree that:
These Terms are between you and Bovel, not Apple. Bovel, not Apple, is responsible for the application and its content.
Your license is limited to use on Apple-branded products you own or control as permitted by the Apple Media Services Terms and applicable Family Sharing or volume-purchase rules.
Apple has no obligation to provide maintenance or support. Contact Bovel at support@bovel.app for support.
If the application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple policy. To the maximum extent permitted by law, Apple has no other warranty obligation.
Bovel, not Apple, is responsible for addressing product claims, legal or regulatory claims, and intellectual-property infringement claims relating to the application.
You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited or restricted parties list.
You must comply with applicable third-party agreement terms when using the application.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
15. General terms
These Terms and the Privacy Policy form the entire agreement concerning the Services and replace prior agreements on the same subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Bovel may assign them in connection with a business transfer or by operation of law.
Unless mandatory law provides otherwise, these Terms are governed by the laws of the State of California, excluding conflict-of-law rules, and disputes will be brought in state or federal courts located in Santa Clara County, California. Consumers retain any mandatory protections and venue rights provided by their home jurisdiction.
We may update these Terms for legal, security, operational, or service changes. We will provide notice where required. If you do not agree to revised Terms, you must stop using the Services before they take effect.
